A Florida mother is charged with driving under the influence and child abuse
after she allegedly crashed her car and left her baby in the backseat after
the wreck.
According to an arrest affidavit obtained by PEOPLE, Josefina Lopez is
accused of crashing her car in a ditch in Clermont, Fla., with her baby on
July 25.
When police responded to the scene, the affidavit alleges, Lopez was
standing outside the vehicle â which had rolled onto its side â and hadnât
attempted to rescue the baby from the car.
Lopez told the responding officer that she was the driver of the car and
claimed she was sober even though she hadnât been asked if she had been
drinking, the affidavit alleges. The officer alleged that he could smell
alcohol on her breath and that Lopezâs eyes were âglassyâ and âbloodshot.â
Lopez allegedly told police she had tried to make a U-turn after missing a
turn when the vehicle flipped over.
The baby was rescued from the car.
A witness told police, according to the affidavit, that after the crash, she
saw Lopez exit the car and heard her allegedly say, âDonât call 911, donât
call 911, help me get my baby, heâs in the car.â
After a minute, the witness said Lopez was on the phone and allegedly said,
âDad, you have to get down here, they already called 911.â
Police say Lopez was arrested on suspicion of DUI, abuse, aggravated abuse
and neglect of a child.
It is not immediately clear if she has entered a plea or retained an
attorney.
